RIPEstat Service Terms and Conditions
Introduction
This document describes the Terms and Conditions under which the RIPE NCC makes the RIPEstat Service available to the RIPE community.
Article 1 – Definitions
In these Terms and Conditions, the following shall be understood to have the meaning assigned to them below:
RIPE NCC – Réseaux IP Européens Network Coordination Centre, a membership association under Dutch law, with registered office in Amsterdam, the Netherlands.
RIPEstat Service – A RIPE NCC service offering access to the RIPEstat Data via the web-based interface on the Website, the RIPEstat Widgets or the RIPEstat Data API.
RIPEstat Data – Current and historical Internet-related data collected by the RIPE NCC, the other RIRs or third parties and provided in a unified form via the RIPEstat Service.
A list of the various RIPEstat Data sources is available on our Website. This list may be updated from time to time to reflect any relevant changes.
The Website – All webpages hosted under the ripe.net domain and any sub-domains thereof.
RIPEstat Widgets – Interactive graphical and visual representations of the RIPEstat Data that can be embedded on other websites by using the provided embedding code.
RIPEstat Data API – The RIPEstat Data Application Programmable Interface (API) that allows the Users to directly interact with the RIPEstat Service.
User(s) – Any person(s) accessing, querying, browsing, viewing, downloading or interacting either directly or through the intermediation of automated means, in any way with (part of) the RIPEstat Service.
Use – Access, query, browse, view, download or interact either directly or through the intermediation of automated means in any way with (part of) the RIPEstat Service.
RIPE community – RIPE (Réseaux IP Européens) is a collective forum open to all parties interested in wide area IP networks in Europe and beyond. The objective of RIPE is to ensure the administrative and technical coordination necessary to enable the operation of a pan-European IP network.
RIR – A Regional Internet Registry that has the authority to register Internet number resources within their respective service region.
Article 2 – General
2.1 The Terms and Conditions come into effect by means of an offer by the RIPE NCC and an acceptance by the User.
2.2 By using the RIPEstat Service, the User confirms that they have read, understood and agree to be bound by these Terms and Conditions. If the User does not agree with these Terms and Conditions, they shall not make use of the RIPEstat Service.
2.3 These Terms and Conditions may be subject to change without prior notice and will be valid upon publication unless specifically indicated otherwise by the RIPE NCC. By continuing to use the RIPEstat Service after any changes are made to the Terms and Conditions, Users confirm that they have read, understood and agree to be bound to these changes.
2.4 These Terms and Conditions replace any and all existing agreements between the RIPE NCC and the User with regards to the RIPEstat Service.
2.5 The Terms and Conditions prevail over explanatory documents and any text regarding the RIPEstat Service, which exist for guidance and informational purposes only and do not affect the interpretation of these Terms and Conditions.
Article 3 – Use of the RIPEstat Service
3.1 The RIPE NCC makes the RIPEstat Service available for purposes such as network analysis, network monitoring and debugging and research (hereafter referred to as the purpose of the RIPEstat Service).
3.2 Users agree to make use of the RIPEstat Service in line with the purpose of the RIPEstat Service as mentioned in Article 3.1 above. If Users perform research using the RIPEstat Service, they must notify the RIPE NCC about the results of this research by sending an email to stat@ripe.net . In such a case the User must also attribute the RIPE NCC and the source of the RIPEstat Data (if different than the RIPE NCC) when they make publicly available their research results generated by any use of the RIPEstat Service.
3.3 A User may not re-package, compile, re-distribute the RIPEstat Service and any (or all) of the RIPEstat Data. Use of the RIPEstat Service for commercial purposes, such as by providing paid services, products or any other derivatives that are based on the RIPEstat Service, or by incorporating the RIPEstat Data with other sources of data and packaging it as commercial product is not allowed unless permission to do so is granted in writing by the RIPE NCC. For such a request, a User may contact the RIPE NCC by sending an email to stat@ripe.net.
Article 4 – Control of Use
4.1 The RIPE NCC has the right to decommission, add, combine any of the RIPEstat Data or alter the form via which the RIPEstat Data is provided according to its own needs, obligations, interests and interests of the RIPE community.
4.2 The RIPE NCC is entitled to restrict any use of the RIPEstat Service. The RIPE NCC may perform reasonable security checks and audits to determine unauthorised use of the RIPEstat Service.
4.3 The Use of the RIPEstat Data is subject to these Terms and Conditions. Specific RIPEstat Data may be subject to additional terms and conditions. In case there is a conflict between these Terms and Conditions and the additional terms and conditions or disclaimers, the additional terms and conditions or disclaimers will prevail over these Terms and Conditions with regards to that particular RIPEstat Data.
Article 5 – Liability
5.1 The RIPEstat Service will be available on a best-effort basis and the RIPE NCC shall not be liable for damages resulting from the unavailability of the RIPEstat, for instance when the RIPEstat Service is not accessible or cannot be used.
5.2 The Use of RIPEstat is at the User’s own risk. The RIPE NCC will not be liable for any inaccuracies. The User shall be liable for all aspects of their Use of the RIPEstat Service including damages following from downloading, installing or using any software from the usage itself.
5.3 The RIPEstat Service may contain hyperlinks to websites that do not fall under the Website and these websites may be subject to different terms and conditions. The RIPE NCC has no control over these websites and it shall not be responsible for the information provided or obtained through these websites or liable for the use and content of these websites.
5.4 The RIPEstat Service contains data that is provided by third parties. The RIPE NCC shall not be responsible for the accuracy of this data and in any case, it is the responsibility of the User to Use this data in accordance with the applicable conditions as stipulated by the third party.
5.5 The RIPE NCC shall not be liable for damages as a result of a failure to meet any obligation under this agreement if such a failure is due to circumstances for which the RIPE NCC is not considered accountable to law, contract or trade custom. The RIPE NCC in any event shall not be accountable for failures to perform resulting from force majeure, including but not limited to interruptions or improper functioning of power of telecommunications services facilities, power failures, denial of service attacks and defects in electronic lines of communication.
5.6 The User indemnifies the RIPE NCC for any third-party claims filed against it in relation to the User’s Use of the RIPEstat Service or resulting from the non-performance by the User of any obligation arising out of these Terms and Conditions.
Article 6 – Miscellaneous
6.1 The RIPE NCC’s intellectual property (agreements, documents, software, databases, website, etc.) may only be used, reproduced and made available to third parties upon prior written authorisation from the RIPE NCC.
6.2 If any provision contained in the Terms and Conditions is held to be invalid by a court of law, all other provisions of the Terms and Conditions will continue to be effective.
Article 7 – Governing Law
These Terms and Conditions shall be exclusively governed by the laws of the Netherlands. The competent court in Amsterdam shall have exclusive jurisdiction with regard to disputes arising from these Terms and Conditions.
