RIPE NCC Certified Professionals - Terms of Use for the RIPE Database Associate Exam

The RIPE NCC Certified Professionals - Terms of Use for the RIPE Database Associate Exam (hereafter: “Terms of Use”) describe your rights and responsibilities when using the RIPE NCC Certified Professionals service for taking the RIPE Database Associate Exam.

Definitions

­In these Terms of Use, the following shall be understood to have the meanings assigned to them below:

RIPE NCC - Réseaux IP Européens Network Coordination Centre, a membership association under Dutch law, with registered office in Amsterdam, the Netherlands.  

User – a test candidate selected by the RIPE NCC to take the Exam to be part of a pilot of the Service. 

Service – the RIPE NCC Certified Professionals programme that the RIPE NCC makes available to Users.

Exam – the RIPE Database Associate Exam is made available by the Service.

Badge – digital representation of the User's credentials gained on successful completion of the Exam that can be shared on different social media platforms or by email by the User.

Voucher – unique alphanumerical code issued by the RIPE NCC that can be used by the User to schedule the Exam.

Applicability

1.1 By using the Service the User confirms that they have read, understood and agree to be bound by these Terms of Use.

1.2 These Terms of Use may be subject to amendments and will be valid upon publication unless specifically indicated otherwise by the RIPE NCC. By continuing to use this Service after any changes are made to these Terms of Use, the User confirms that they have read, understood and agree to be bound to these amendments.

User’s Responsibilities

2.1 The User is solely responsible for: 

  • using the Voucher to schedule an Exam by 30 September 2019, after this date, the Voucher will no longer be valid. Exam scheduling is subject to availability and can be done 90 days in advance. If the scheduled Exam is not cancelled 48 hours before the start of the Exam, the Voucher shall no longer be valid and can no longer be used. In case the User cancels a scheduled Exam 48 hours before the start of the Exam, the User can reuse the Voucher for rescheduling the Exam by 30 September 2019.
  • taking the Exam. In case of a no show, the Voucher will no longer be valid and can no longer be used
  • ensuring the requirements, as set out in the Important Candidate Information and Exam Information, are strictly followed before and during the Exam. This also includes following the instructions and/or comments given by the proctor who is remotely monitoring the Exam. The proctor has the ability to stop or pause the Exam if the User does not act in accordance with these responsibilities.
  • showing one form of a government-issued identification before the start of the Exam to the proctor who is remotely monitoring the Exam (e.g. Driver’s license, national identification card, passport, permanent resident card). The proctor reserves the right to ask for additional identification if there is any doubt to a User’s identity

2.2 The User shall not copy, share, modify or involve themselves in any behaviour that can result in disclosing the Exam, including questions and/or content of the Exam, to any other third-party.

2.3 The User may be prohibited from taking this Exam if the User violates these Terms of Use. If the User already received a badge and the User violates these Terms of Use, the RIPE NCC has the right to decertify the User from the Service.

2.4 The User is required to create an account with both PSI Services and Credly’s Acclaim platform to be able to use the Service. The User understands that if they cannot agree to this requirement, they cannot use the Service and therefore, the User cannot become a RIPE NCC Certified Professional.

Privacy

3.1 For the RIPE NCC to provide the Service to the User, the RIPE NCC needs to collect and process personal information. This includes the User’s name; address; email address; telephone number; scoring, ranking, and assessment data; photo of the ID shown and photo of the User (will be taken before Exam). When this data is collected for analytical purposes, this data shall only be used anonymised.

3.2 The User acknowledges and agrees that the RIPE NCC has entered into a contractual relationship with PSI Services to provide the Service, meaning that they will process personal information on RIPE NCC’s behalf. 3.3 When the Use successfully completes the Exam, PSI Services will transfer the User’s email address, the User’s name and the specific time the Exam ended to Credly’s Acclaim platform - a third party that entered into a contractual relationship with PSI Services to provide the User with the badge. This data shall be transferred outside of the EU and will take place in compliance with the US privacy shield. 3.4 For further details on how the RIPE NCC processes personal information and other data and instructions on how to access and change this data, please contact exams _at_ ripe _dot_ net. In any case, any personal information provided to the RIPE NCC is subject to the RIPE NCC Privacy Statement

 

Liability

4.1 The RIPE NCC shall provide the Service on a best effort basis and shall not be liable for damages resulting from the unavailability of the Service, for instance when the Service is not accessible or cannot be used.

4.2 The Service may contain hyperlinks to other websites and/or pages that do not fall under the Service and therefore may be subject to different terms and conditions. The RIPE NCC shall not be responsible or liable for the use of the information provided or obtained through these websites and/or pages.

4.3 The RIPE NCC shall not be liable against the User for any direct, or indirect, damages caused by the RIPE NCC to meet any obligations under these Terms of Use, including damages to the User’s business or loss of profits, unless these damages are a result of gross negligence from the RIPE NCC.

4.4 The RIPE NCC shall not be liable for damage as a result of a failure to meet any obligation under these Terms of Use if such failure is due to circumstances for which the RIPE NCC is not considered accountable to the law, contract or trade custom.

4.5 The User indemnifies the RIPE NCC for any third-party claims filed against the RIPE NCC concerning the use of the Service or for any obligation arising out of these Terms of Use.

4.6 The RIPE NCC cannot be held responsible for the Service not being available in certain countries due to international restrictions or sanctions.

Appeals Process

5.1 The RIPE NCC is responsible for the quality of the questions and the evaluation of the answers that are accepted as correct in the Exam. In case the User challenges the quality of a question or the evaluation of their answer or the outcome of their Exam, the User may place an appeal. The User can do this by sending an email that includes the name of the User, name of the Exam, the date of the Exam and details that the Appeals Committee should be aware of to exam-appeals _at_ ripe _dot_ net. General Provisions

6.1 If any provision in these Terms of Use is held to be invalid by a court of law, all other provisions of these Terms of Use will continue to be in effect and enforceable.

6.2 These Terms of Use shall be exclusively governed by the laws of the Netherlands. The competent court in Amsterdam shall have exclusive jurisdiction concerning disputes arising from these Terms of Use.
