The RIPE NCC Executive Board welcomes this feedback and has followed the discussion on the members-discuss mailing list and at RIPE NCC General Meetings. A Charging Scheme Task Force was established with representatives from different membership categories, as well as members of the RIPE NCC Executive Board and RIPE NCC staff, in order to provide recommendations for updating the Charging Scheme model. In response to the feedback from members and the Charging Scheme Task Force, the RIPE NCC Executive Board has developed a proposal for a new Charging Scheme model. In very broad terms, this model creates a simplified fee structure where the majority of members pay the same fee. The income derived from these membership fees covers the majority of the RIPE NCC?s operational costs. The proposal is available at: www.ripe.net/lir-services/ncc/gm/september-2012/ We have produced this proposal in answer to members? discussion of the current Charging Scheme model and by following, as closely as possible, the recommendations of the Charging Scheme Task Force. The purpose of publishing this proposal now is to encourage RIPE NCC members to look at the proposed new model and to give their feedback. The Executive Board will be meeting again in early August 2012 to finalise the proposal that will be presented for a formal vote at the RIPE NCC General Meeting 2012. We urge you to send us any comments or concerns you have about the proposed model by the end of July. It was suggested that this provision gives unlimited liability by the membership to the RIPE NCC and, consequently, unlimited financial backing of the RIPE NCC by the members. It was said that the RIPE NCC should not ask all members to guarantee its liability in an unlimited way and it was suggested that the provision be amended as soon as possible. The RIPE NCC reviewed the provision and came to the following conclusion: This provision requests that the member must indemnify the RIPE NCC if: - A third party files claims against the RIPE NCC; and - These claims refer to this member's use of the RIPE NCC's services If the claim refers to a particular member's use of the RIPE NCC's services, then no other member has an obligation to indemnify the RIPE NCC. The aim of the provision is that an individual member should indemnify the RIPE NCC against a third party claim against that individual member. The indemnification does not carry beyond these parties (the RIPE NCC and the specified member). If a member infringes a third party's rights through the use of the RIPE NCC's services, then this member is liable for their own actions. If the RIPE NCC could not require such indemnification, then the RIPE NCC itself (i.e., the whole membership) could be obliged to compensate any third party for illegal activities of a certain member. Under legal advice, the RIPE NCC has decided to retain the clause in its current form. If a claim is filed against the RIPE NCC, the penalty or compensation can be passed on to the member specified in the claim, leaving other members unaffected. The term of Dave Wilson, who was elected to the NRO NC in January 2009, ends on 31 December 2012. The election to the NRO NC seat will take place during the Plenary at the RIPE 65 Meeting to be held in Amsterdam from 24-28 September 2012. All members of the Internet community who are present at that Plenary may vote in the election. The deadline for nominations is 28 August 2012.
