People outside the US may always use the US courts as plaintiff if they have
been damaged by a US spammer.  Conversely, if someone in the US wants to sue
a foreign spammer, the foreign spammer must sufficient sufficient "contacts"
with the US such that hauling the spammer into US court does not offend
"traditional notions of fair play and substantial justice" and any
applicable treaty provisions.  When a spammer causes damage to a domain in
the US, for example, it will usually be fair for them to answer to a US
court (if you can find and serve them).   So once there is a sufficient US
connection, the "impossibility" of using the US courts is only one of cost
and desire to proceed.  I can't speak for the courts of other countries.
