I have a feeling that we are trying to solve the poor performance of some
players in this business with addressing policy. 

The easiest and best way for a customer to get resiliency is 

a) Get a provider that is a Tier-1 or have multiple upstreams
b) Make sure you provider have a resilient network
c) Get dual (really) connections to your provider.

I assure you this will be cheaper than to get your own address space, LIR
status, and God knows what.

If a provider can't supply the above to a customer that really have the
need for multiple connections and is willing to pay for it, I would change
provider anyay.
